After placing his head down, another student was instructed to use smelling salts on him, despite his documented allergies. Caschera responded by restraining N.W. to a backboard, subjecting him to discomfort. Witnesses reported that he had to simulate coughing to be released.The lawsuit accuses various parties of unlawful conduct, asserting that the actions reflected a clear abuse of authority and discrimination, as N.W. was the only Black student subjected to public humiliation.
