Eddy Kirby, a 45-year-old Black man from Iowa, encountered two police officers threatening to arrest a homeless individual for alleged shoplifting. Knowing the man from his community, he offered to cover the cost of the disputed items. However, the officers, Michael Hoopes and Bryan Loftus, retaliated by handcuffing Kirby, accusing him of obstructing their investigation.In response, Kirby has launched a federal lawsuit against both officers as well as the city of Des Moines, asserting violations of his Fourth Amendment rights and false arrest. The lawsuit highlights the lack of probable cause, as Kirby merely inquired about bail from a distance. Later, he faced another unlawful detainment by a different police department while filing his lawsuit, being accused of resembling a suspect in a past incident.
