Manhattan businessman Jose Sandy Buco has submitted an urgent request to the New York State Supreme Court, contesting what he deems an “illegal” sale of his property scheduled for July 23, 2025, while an appeal is pending in U.S. District Court. On July 18, 2025, Mr. Buco registered a notice of appeal in State Supreme Court to alert the court of his ongoing federal proceedings concerning two additional properties he alleges are targeted for wrongful foreclosure by “debt buyers.”
Mr. Buco’s petition, filed on July 17, 2025, seeks a temporary restraining order to halt the auction, asserting that such actions could inflict irreparable harm as they conflict with federal jurisdiction. He contends that Judge Philip Bentley in the U.S. Bankruptcy Court improperly dismissed his case prior to his scheduled hearing on October 17, 2024, where he intended to contest the legitimacy of his alleged $6.4 million debt, well above the Chapter 13 limit.
