Consequently, Tole claims he has endured severe permanent disfigurement, debilitating physical injuries, emotional distress, and other damages. Specifically, Tole highlights significant harm to his head, jaw, and neck. Furthermore, Tole contends that Fox should have recognized Sanchez's unsuitability for employment given his “tendency for drinking and/or risky behavior.” Sanchez was in Indianapolis to commentate on the Colts vs. Raiders game but was supplanted by Brady Quinn post-incident. Tole seeks both compensatory and punitive damages.
