A federal appeals court issued a divided verdict in the notable case concerning Marilyn Mosby, the former Baltimore State’s Attorney who gained national attention before confronting criminal allegations regarding her finances. In a 2-1 decision, the U.S. Court of Appeals for the 4th Circuit overturned Mosby’s mortgage fraud conviction, determining that the venue for prosecuting that charge in Maryland was inappropriate. This ruling also reinstates her Longboat Key, Florida, condominium, valued at over $900,000. However, the court maintained Mosby’s perjury convictions related to her withdrawal of funds from her city retirement account during the COVID-19 pandemic. A prior jury established that Mosby falsely asserted financial hardship to access the funds under the CARES Act, which she used to finance two Florida vacation properties. Judge Stephanie Thacker noted that the evidence regarding fund utilization was justly admitted to prove economic harm. Judge Paul Niemeyer partially dissented, arguing that Mosby’s conduct justified the original venue. Mosby maintains her stance on political motivation behind the charges.
